ARIIA AI LLC (“we,” “us,” or “our”) operates the ARIIA AI platform (the “Service”), a cloud-hosted SaaS platform using AI agents to automate voice and messaging interactions for businesses, accessible at https://www.ariiaai.com/, as further described in our Terms of Service. This Privacy Policy explains how we collect, use, and protect your information. By using the Service, you consent to these practices and our Terms of Service.
INFORMATION WE COLLECT
A. Personal Data
- When you create an account or use the Service, we may collect:
- User Information: Full name, email, phone number, business name (including DBA, if applicable), business address, business phone number, and business EIN (optional).
- Customer Interaction Data: Call recordings, transcripts, summaries, and related metadata generated through use of the Service.
- End-Customer Data (or Customer-Provided Details): Information provided by an End Customer (an individual interacting with a business using ARIIA AI, including callers and individuals who receive SMS messages through the Service), including names, phone numbers, email addresses, delivery addresses, appointment details, reservations, or order details.
- SMS Data: Phone numbers and message content sent or received through the Service.
B. Voice Cloning / Biometric Data (Optional)
- Processing biometric data (voice patterns) is only done if voice cloning features are enabled.
- Data is used solely for requested features; not for advertising, profiling, or unrelated model training.
- You are responsible for obtaining all required consents and complying with applicable laws, including all-party consent states (e.g., CA, FL, WA).
C. Technical & Usage Data
- IP address, device type, browser, OS, call duration, feature usage, and error logs.
D. Job Applicant Information
- Name, email, resume, LinkedIn, and education are collected solely for recruitment purposes.
E. SMS Data (Platform & Plan Usage)
Transactional SMS – Platform Notifications:
- We collect and process SMS message data, including phone numbers, timestamps, message content, and usage counts, for messages sent to account users necessary for Service functionality, such as verification codes, password resets, and important notifications.
- This data is used to provide the Service, ensure delivery of essential messages, and manage account access.
Transactional SMS – Plan Usage (to End Customers):
- We collect and process SMS message data, including phone numbers, timestamps, message content, and usage counts, for messages sent under your Subscription or Pay-As-You-Go plan, including those sent to End Customers.
- This data is used to provide the Service, monitor plan usage, ensure delivery of transactional messages, and track overages.
- Data is retained only as long as necessary to provide the Service, comply with legal obligations, or manage billing and account-related activities.
Marketing SMS (to End Customers):
- Businesses using ARIIA AI are responsible for obtaining express consent from End Customers prior to sending marketing or promotional SMS messages, in compliance with applicable laws (including TCPA and CTIA guidelines).
- Consent may be obtained through any verifiable method, including verbal agreement, written consent, or other documented opt-in.
- ARIIA AI provides technical tools to send messages and manage opt-outs but assumes no responsibility for businesses’ compliance or violations.
- Opted-out numbers must be permanently blocked, and all SMS must honor opt-out requests; businesses may not circumvent opt-out mechanisms.
Retention & Use:
- SMS data is retained only as long as necessary for the purposes described above, including delivering the Service, tracking usage, billing, or complying with legal obligations.
- Transactional SMS usage data is processed in accordance with the SMS Data collection practices outlined above.
HOW WE USE INFORMATION
We use collected information to:
- Operate, maintain, and improve the Service.
- Enable AI-powered interactions (calls, bookings, reservations, orders).
- Generate call recordings, transcripts, summaries, and analytics.
- Process subscriptions, billing, and payments via third-party providers.
- Create and manage accounts and personalize user experiences.
- Monitor usage and trends to improve performance and efficiency.
- Notify you of updates, changes, or new features.
- Recommend new products, services, or updates.
- Respond to service and product requests.
- Perform other business activities as needed to provide and enhance the Service.
- Communicate account notifications and transactional messages.
- Enforce Terms of Service, prevent misuse, and comply with legal obligations.
CALL RECORDING & BUSINESS RESPONSIBILITY
- Call recording is an optional feature.
- Businesses are solely responsible for complying with all applicable federal, state, and international laws governing call recording, including one-party or all-party consent requirements (e.g., notifying participants where required).
- Businesses are responsible for providing End Customers with clear disclosure when interacting with AI-generated or AI-assisted voices, particularly where required by law (e.g., California AB 2905). ARIIA AI LLC is not responsible for compliance with state-specific AI voice consent requirements.
- We strongly recommend providing clear notice to all participants (e.g., “This call may be recorded”) to ensure compliance across jurisdictions.
- ARIIA AI LLC does not monitor, validate, or assume any responsibility for your legal compliance.
SMS COMMUNICATIONS & CONSENT
Transactional Messages – Platform Notifications:
- Necessary messages, such as verification codes, password resets, and important notifications, are sent automatically. Message and data rates may apply.
- You may opt out at any time via instructions included in the messages or by contacting our support team.
Marketing SMS (to End Customers):
- Businesses are responsible for obtaining express consent from their End Customers prior to sending Marketing SMS messages.
- Consent may be obtained through any verifiable method, including verbal agreement, written consent, or other documented opt-in.
- ARIIA AI provides technical tools to send messages and manage opt-outs but assumes no responsibility for businesses’ compliance or violations.
- Opted-out numbers must be permanently blocked, and all SMS must honor opt-out requests; businesses may not circumvent opt-out mechanisms.
Retention:
- Message content is retained only as long as necessary for the Service or to comply with legal obligations.
HOW WE SHARE INFORMATION
- Third-Party Service Providers: We may share information with vendors performing functions for us, such as payment processing, cloud hosting, AI/ML services, communications, and scheduling integrations.
- Affiliates, Sales Representatives, Partners, and Business Collaborators: We may share information with internal or external teams who support, manage, or facilitate your use of the Service.
- Marketing & Publicity: We may showcase customer businesses, logos, or non-sensitive details in case studies, website features, social media posts, or other promotional materials only with the customer’s consent. Personal or sensitive information will never be used without explicit permission.
- Legal & Security Disclosures: We may share data if required to investigate fraud or comply with legal obligations.
DATA SECURITY
- We implement administrative, technical, and organizational safeguards (encryption in transit and at rest, access controls, secure cloud hosting).
- No system is completely secure; we cannot guarantee absolute security.
DATA RETENTION & POST-TERMINATION HANDLING
- Information is retained only as long as necessary for the Service, legal obligations, or enforcement of agreements.
- Upon subscription termination, your data will be handled in accordance with these retention practices. Businesses remain responsible for call recordings and SMS compliance after termination if they maintain copies locally.
USER RIGHTS

- Opt out of marketing communications at any time.
- International users: Service is for U.S. customers only.
CHILDREN’S PRIVACY
- Accounts under 18 are prohibited; discovered accounts will be removed.
THIRD-PARTY SERVICES
- We may share information with third-party service providers that help us operate and deliver the Service, including providers for payment processing, communications, cloud hosting, analytics, scheduling, call transcription, and artificial intelligence. These providers are subject to their own privacy policies and terms.
- For most providers, data is processed only as necessary to perform services on our behalf. However, certain features (particularly AI and transcription) may send data (e.g., audio, text inputs) to external providers, who operate under their own privacy policies. We encourage you to review those policies.
- We are not responsible for the privacy practices, security, or content of third-party services not owned or controlled by ARIIA AI LLC.
STATE-SPECIFIC PRIVACY RIGHTS
- Residents of CCPA or VCDPA states may have rights to access, delete, or opt-out of the sale of personal information.
- We do not sell personal information.
GOVERNING LAW & DISPUTE RESOLUTION
- Privacy disputes are governed by Delaware law and resolved via binding arbitration, consistent with the Terms of Service.
